Subject: Sell or Gift of Alcohol to an Underage Person
While camping in a Federal Park where consumption of alcohol is legal, a park
ranger (federal officer) stopped by our campsite and asked to see our
identification. It turns out that a friend of mine, whom I had only known for a
couple of weeks was only 20 years of age. The ranger cited the underage person
with possession of an alcoholic beverage and gave me a citation of "Gift
or Sell of Alcohol to an Underage Person". This is a mandatory federal
court appearance.
My question is how should I go about this. I have never had anything on my
record and do not want this offense to be there either. I am willing to pay a
fine, community service or whatever I can do to keep this off my permanent
record. I have never been in court and don't know the process, so how should I
approach the judge and what should I ask for? Any help or advice would be
greatly appreciated. Thanks.

Subject: You need to talk to a criminal lawyer
You need to talk to a criminal lawyer, but I understand that minor offenses
like this can eventually be expunged from your record. In addition to
consulting with a criminal lawyer, I would look up the particular U.S. Code
violation written on your citation. Then you will see the elements of the
crime. If you scrutinize those elements, you can help your lawyer prepare
a defense if all of the elements of the crime are not present.

Subject: Legal age range for dating.
I am not sure if I choose the correct area for this question. I am trying to
figure out what is the legal age range in Tennessee to date someone that is
older/younger then you. I know in some states it is different, but I am unaware
of what Tennessee's Law is on this matter. Please help me.

I wish we lived in a world where "dating" meant simply platonic
dating, as with my parent's generation. An adult cannot have sex with a
minor under the age of 18 -- and that includes a prohibition on fondling,
carressing, etc. I am not an expert in this area, but I believe minors
who have consensual sex with other minors or with an adult no more than 3 years
older than they are would not trigger the statutory rape laws. But do not
take my word for it on the 3-year age difference. You need to investigate
that point yourself. A person who reaches age 18 is a legal adult and can
decide for himself/herself who she wants to date -- assuming she is not
impaired and has mental capacity to make those decisions for herself.
=========== Question: http://www.lawguru.com/cgi/bbs/mesg.cgi?i=960786994 =========== Category: Civil Rights Law Location: PA Subject: mishandled rape case of minor my friends daughter was raped in college. She was a minor at the time. The college was notified, the police and the girl were taken to the hospital. No one ever called the parents of the minor. The correct tests were not taken in order to have enough evidence to prosecute. Meaning rape kit nor blood test to see if she was drugged. This happened in a very prominent school. We believe they are trying to cover it up. The school even told the young lady to leave the school. What type of lawyer should she talk to about this, because I know the entire case was mishandled and the boys will probably not even have to stand trial for their actions. Nothing has been done to the boys as of yet. It is just business as usual. I thank you in advance for any and all information. Desperately looking for help for my friend who does not know where to turn! =========== Reply: http://www.lawguru.com/cgi/bbs/mesg.cgi?i=31025621 =========== Category: Civil Rights Law Location: PA Subject: Re: mishandled rape case of minor The rape and negligence related to it are personal torts, so you would like to find an aggressive personal injury lawyer. However, given that the criminal prosecution was not performed and the possible allegations of school complicity, it would be best to find a lawyer who does both criminal defense and personal injury work. =========== Question: http://www.lawguru.com/cgi/bbs/mesg.cgi?i=907900143 =========== Category: Civil Rights Law Location: IN Subject: eighth amendment where do start if your eighth amendment has been violated? =========== Reply: http://www.lawguru.com/cgi/bbs/mesg.cgi?i=115672244 =========== Category: Civil Rights Law Location: IN Subject: Re: eighth amendment How were your U.S. Constitution Eighth Amendment rights violated? =========== Question: http://www.lawguru.com/cgi/bbs/mesg.cgi?i=852926277 =========== Category: Legal Ethics & Professional Responsibility Location: TN Subject: police department failing to uphold the lawMy question is. Would it be possible to sue a law enforcement aggency or local goverment for failure to uphold the law? I live in a county where riding ATVs (four wheelers) on county/city roads is against the law. However when you call the police they say that they don't bother to stop them because there are so many of them. I was wondering could they be sued for mental anguish due to the fact that I can not even put my 2 year old down for a nap without being woke up by them and it is impossible to get to sleep myself due to the noise. It was so bad in my old neighbor hood that I sold my house and moved and now I flinch everytime that I hear a loud motor. The ATVs are not as bad so far but there are still present.

However, do you care enough about this problem to pay a $134.50 filing fee + $200 to an attorney to draw up the paperwork for you? http://michaelguth.com/prose.htm

I could draw up a petition for you to file to have your records expunged, but I normally help people represent themselves, rather than appear in court on their behalf.
